29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. 29 CFR 1926.501(b)13): The employer does not protect employee(s) engaged in residential construction activities 6 feet or more above a lower level from falling to that lower level. This violation was most recently observed on 6/28/2012 at a work site on Christian Way Andover, MA, 01810 were guardrail, safety net or personal fall arrest systems were not used on the second floor wall openings and stairway openings, exposing employees to falls up to 19 feet. Thomas Allen DBA Thomas Allen Construction has been previously cited for this practice as described below. To abate this violation, the employer must ensure that equipment necessary to protect employees against falls from roofs is available at its worksites and that such equipment is used to protect all employees who work on roofs more than 6 feet above a lower level from falling to that lower level. Thomas Allen DBA Thomas Allen Construction was previously cited for violation of this Occupational Safety and Health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA Inspection number 315092429. Citation number 01, item number 001 issued on 12/13/2010, and was affirmed final order on 01/26/2011, with respect to a worksite located at 1 Christian Way Andover, MA, 01810. Thomas Allen DBA Thomas Allen Construction was previously cited for violation of this Occupational Safety and Health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA Inspection Number 315871608, Citation Number 02, Item number 001 issued on 11/18/2011, and was affirmed as a final order on 01/03/2012 with respect to a workplace located at Salem Road Billerica, MA, 01821. Date by which violation must be abated: Immediately upon receipt of this citation. Pursuant to 29 CFR 1903.19(d), the employer must provide documentation that this violation has been abated within 10 calendar days after receiving the citation.
