29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures: a) Intersection of Convent Ave and Market St in Pascagoula, MS -- On or about June 26, 2012, employees were exposed to possible collapse of the street pavement because soil was removed from under the pavement on two sides. The soil sample tested to be Type B soil.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) Intersection of Convent Ave and Market St in Pascagoula, MS -- On or about June 26, 2012, employees were not removed from the excavation when there was evidence of the soil cracking on two sides and the removed soil under the pavement on two sides.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section; a) Intersection of Convent Ave and Market St in Pascagoula, MS -- On or about June 26, 2012, there was no support system to prevent cave-ins of the excavated sides since adequate sloping could not be used because of the surrounding roads and vehicular traffic. The soil sample tested to be Type B soil.
