29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a. Where solvent based paints, thinners, and other spray paint products were used during painting and body work, including chemicals that can result in systemic illness and fire hazards, a chemical hazard communication program was not developed and written, on how training was to be provided (health and physical hazards, such as fire and explosion); what controls were to be used to prevent injury and illness, such as proper fitting of respirators, grounding/bonding of flammable liquid containers, keeping containers and trash cans of flammable residues covered, and proper storage of containers; keeping material safety data sheets on all chemical products, including in an organized manner with an index so that the data sheets can be readily retrieved; and ensuring proper labeling of all containers.    Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citation(s).

29 CFR 1910.134(c)(1):     A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    a. Where solvent based paints, thinners, and other spray paint products were used during painting, a respiratory protection program was not developed and written, including training, how respirator users were to be fit tested (incuding annually), providing medical evaluations to users of negative pressure respirators, cartridge change schedule or procedures, how respirators were to be cleaned and stored, who was responsible for the program and how the program was to be periodically inspected and evaluated (as described at 1910.134(c)(1)(i) through (ix).    Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citation(s).
