Condition exposed employees to the hazard of projectiles to the eyes.

29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph (b). Note: If using these systems was infeasible or created a greater hazard, the employer did not develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502: a) Ceja Construction, LLC at 2250 Krisron Rd., Fort Collins, CO 80528: On or before July 7, 2012, the employer did not ensure that employees were protected from residential construction fall hazards in the following instances: 1) Five window wall openings had the lower ledge set at 24", and no upper guardrails were in place, with fall hazards of 11'4' to the outside ground; 2) Six window wall openings had the lower ledge set at 36', and no upper guardrails were in place with fall hazards of 11'4' to the outside ground; and 3) The second floor included an opening around the stairway hole measuring 9'6" long x 5'2" wide, with a fall hazard of 10' to the inside floor. Abatement note: 29 CFR 1926.502(b)(1) provides that the top edge height of top rails shall be 42" +/- 3". Conditions exposed employees to fall hazards of up to 11'4".

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches, whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge: a) Ceja Construction, LLC at 2250 Krisron Rd., Fort Collins, CO 80528: On or before July 7, 2012, the employer did not ensure that employees were protected from fall hazards when using the stairs to access the second floor and to access the basement, in that both sets of stairs were missing stairrails and hand rails on both open sides. Both sets of stairs included 16 steps, with a rise of 7 3/4" over a run of 10 5/8". Condition exposed employees to fall hazards of up to 10'. Abatement note: 29 CFR 1926.1052(c)(3) provides that the stairrails shall not be less than 36" from the upper surface of the stairrail system to the surface of the tread. This section also provides that midrails shall be provided between the top rail and the stairway steps.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step: a) Ceja Construction, LLC at 2250 Krisron Rd., Fort Collins, CO 80528: On or before July 7, 2012, the employer did not ensure that an employee was protected from fall hazards when using an 8' Werner stepladder, model NXT1A08, in that that an employee leaned the ladder against the top of the garage door without opening and locking the spreaders, and used the top and top step of the stepladder, and leaned over off-center to use a pneumatic nail gun to nail an upper triangular OSB board to the front of the garage. Condition exposed this employee to a fall hazard of 8'.

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: a) Ceja Construction, LLC at 2250 Krisron Rd., Fort Collins, CO 80528: On or before July 7, 2012, the employer provided a splitter that was missing its ground plug. Two extension cords were plugged into it and were used to power 120 volt circular saws and portable electric tools. Condition exposed this employees to electrical shock hazards.
