29 CFR 1926.1053(b)(1):     Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    a)  104 Statboard Way, Mt. Laurel, NJ:  The employees were using a ladder to access the roof that was not 3 feet above the upper landing surface, observed on or about 7/2/12.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13):     29 CFR 1926.501 (b)(13) Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system.    a)  104 Starboard Way, Mt. Laurel, NJ:  The employees were preforming sheathing activities on a new two story residential home.  The employees were not utilizing fall protection when working at a height from the ground level greater than 25 feet to the eave of the roof of the residential structure, observed on or about 7/2/12.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.     AMERICA BUILDERS INC.; WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDAR, 1926.501(b)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 315977869 CITATION NUMBER 01, ITEM NUMBER 003, ISSUED ON 12/2/11.
