29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    (a) Woodhaven Apartments & Townhomes at 2470 S. Quebec St, Denver, CO 80231:  On and before June 26, 2012, the employer did not ensure the spoil pile on the trench was 2 feet (.61m) from the trench. The excavation measured 46 feet in length, 8 feet in depth, and 3.5 feet wide.  This condition exposed the employees to the hazard of the materials falling into the trench or causing the trench to collapse.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions:    (a) Woodhaven Apartments & Townhomes at 2470 S. Quebec St, Denver, CO 80231:  On and before June 26, 2012, the employer did not ensure that daily inspections of the excavation, that measured approximately 8 feet in depth, and the adjacent area were made by the competent person for evidence of a situation that could have resulted in a hazardous condition, in that the competent person did not identify the lack of an appropriate protective system or did not take prompt corrective action to eliminate the cave-in hazard.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):    (a)	Woodhaven Apartments & Townhomes at 2470 S. Quebec St, Denver, CO 80231:  On and before June 26, 2012, the employer did not ensure that the employee conducting work in the sewer line excavation was protected from cave-in, in that the excavation was 8 feet deep and the working area was approximately 46 feet long and lacked any protective system, such as appropriate sloping, benching, or shield system.  This condition exposed the employee to a crushing hazard by excavation wall cave-in.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed:    (a) Woodhaven Apartments & Townhomes at 2470 S. Quebec St, Denver, CO 80231:  On and before June 26, 2012, the employer did not ensure that employees used a ladder in a manner for which it was designed in that a 8 foot tall step ladder was used as an extension ladder as a means of egress inside an 8 foot deep trench.  This condition exposed the employees to the hazard of a possible failure of a means of egress.
