29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    a) West End of the Foundation Excavation - A concrete worker was observed without using the provided eye protection, cutting steel reinforcing rods using a Stihl TS420 concrete saw exposing him to a potential eye hazard.    b) West End of the Foundation Excavation - A concrete worker was observed without using the provided eye protection breaking a channel into a concrete footer exposing him to a potential eye hazard.

29 CFR 1926.501(b)(6): Each employee on ramps, runways, and other walkways was not protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems:    a) East End of the Foundation Excavation - Concrete workers were observed using a concrete form as a make shift ramp for access and egress into an excavation exposing them to a 6 foot 6 inch fall hazard.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    a) Throughout the Foundation Excavation - Concrete workers were observed working on the opposite end of the foundation excavation where the only means of egress which was a concrete form used as a make shift ramp in an excavation located 90 feet away exposing them to a potential cave-in hazard.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) West End of the Foundation Excavation -  Concrete workers were observed working against face of the foundation excavation where the 10 foot high spoil was located directly at the top edge of the 7 foot deep excavation exposing them to a potential cave-in hazard.    b) South side of the Foundation Excavation - A concrete workers was observed working against face of the foundation excavation where the 3 foot high spoil was located directly at the top edge of the 7 foot deep excavation exposing them to a potential cave-in hazard.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement:    a) Throughout the Foundation Excavation - Protruding reinforcing rods were not guarded to prevent impalement of workers. Numerous concrete workers were observed working over top of unprotected steel reinforcing rods preparing for installation of extensions and concrete forms exposing them to impalement hazards.
