29 CFR 1910.147(c)(1):     Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    The employer is failing to develop written Lockout and Tag Out program specific to their business.  This was most recently evident during the inspection of the facility located at 1215 E. J Street, Hastings, NE 68901, where the employer has employees conducting maintenance on semi-trucks and trailers without having developed a set of written specific procedures that outline the step by step method to safely de-energize the equipment and lockout against all forms of stored energy, as evident in the accident where an employee had partial amputation of a finger on his right hand. Other program deficiencies include but not limited to:    i.  Failure to identify the companys training method, personnel to be trained and training plan, specifically who are the authorized, affected and all others.    ii.  Failure to identify the companys written specific procedure necessary to isolate the hazardous energy sources associate with semi-trucks and trailers.    iii.  Failure to identify the companys method of conducting annual periodic reviews of written specific procedure associate with semi-trucks and trailers.    iv.  Failure to identify the employer/subcontractor agreement on the use of Lockout/Tag Out programs in the event that this company doesnt perform maintenance on the semi-trucks and trailers.
