29 CFR 1926.451(f)(15): Ladders shall not be used on scaffolds to increase the working level height of employees, except on large area scaffolds where employers have satisfied the following criteria: On or about 07/09/2012, the employer did not ensure that step ladders were used by employees to gain access to a higher elevation while working from a scaffold. An employee was observed working from a 5 ft folded step ladder that was leaning against the outside wall of the structure and was bearing on the work platform of a tubular welded scaffold that was 6.5 ft above the ground.

29 CFR 1926.451(f)(15)(i): When the ladder is placed against a structure which is not a part of the scaffold, the scaffold shall be secured against the sideways thrust exerted by the ladder; On or about 07/09/2012, the employer did not ensure that the scaffold was secured to prevent sideways movement due to forces applied by the ladder. An employee was observed working from a folded 5 ft step ladder that was bearing on a scaffold that was not plumb which reduces the forces applied needed to tip the 6.5 ft (ground to work platform) scaffold

29 CFR 1926.452(c)(2): Frames and panels shall be braced by cross, horizontal, or diagonal braces, or combination thereof, which secure vertical members together laterally. The cross braces shall be of such length as will automatically square and align vertical members so that the erected scaffold is always plumb, level, and square. All brace connections shall be secured. On or about 07/09/2012, the employer did not ensure that scaffolding used by employess was plumb or level. An employee was working from a folded 5 ft step ladder on top of a 6.5 ft high scaffold. The scaffold was leaning away from the structure approx 5 degrees and the legs of the scaffold were bearing on soil. This exposes the employee to falls from an elevation of up to 10 ft

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: On or about 07/09/2012, the employer did not train employees by a competant person in how to recognize hazards associated with scaffolding and how to minimize those hazards before use. By not properly training employees, they are are potentially exposed to fall hazards, scaffold collapse, etc.
