OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall/struck-by hazards while riding on the tailgate of a moving pick-up truck:     On or about July 10, 2012, employees at the apartment complex were tasked with transporting furniture in the bed of a 3/4 ton pickup truck to a trash dumpster located on the property.  Two employees were not properly seat belted in that they were riding on the lowered tailgate of the truck while it was in motion thus exposing them to fall/struck-by hazards.
