29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section  for cave-in protection.    The employer does not ensure  that each employee is protected from by an adequate cave-in protection. An employee was observed on or about July 16, 2012 exposed to a crush-by hazards when he was working in a trench 6.5 feet deep without cave-in protedtion.    Paskey, Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 313733941, citation1, item number 2 and was affirmed as a final order on 12/11/2009 with respect to a workplace located at NE corner of Woodland Hills and FM 1960 in Humble, Texas.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are provided cave-in protection when they are working in a trench.
