29 CFR 1910.333(c)(3): When work was to be performed near overhead lines, the lines were not deenergized and grounded, nor were other protective measures provided before work was started: (a) On or about July 25, 2012, at 3611 Charles Street, Saint Joseph, Missouri, an employee was tree trimming approximately 25 feet above ground in an aerial lift using a telescopic pole chain saw which had a total length of 12 feet 7 inches. The employee was fatally injured when the saw came in contact with an unguarded 7200 volt power line. Abatement verification is not required for this item.

29 CFR 1910.333(c)(3)(i)(A)(1): When an unqualified person was working in an elevated position near overhead lines with voltages to ground rated at 50 kV or below, the location was not such that the person and the longest conductive object he or she could contact would not come closer to any unguarded, energized overhead line than 10 feet (305 cm): (a) On or about July 25, 2012, at 3611 Charles Street, Saint Joseph, Missouri, an employee was tree trimming approximately 25 feet above ground in an aerial lift using a telescopic pole chain saw with a total length of 12 feet, 7 inches. The employee was fatally injured when the saw came in contact with a 7200 volt power line. Abatement verification is not required for this item.
