29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: On or about July 30, 2012, at the construction site, where employees were walking by the front of the residential buildings under construction while other employees were throwing plywood scraps out the window, exposing employees to the hazard of being struck by materials or debis. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected by protective helmets while working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. On or about July 30, 2012 at the construction site where an employee was standing on the exterior wall of the residential building and was not provided with fall protection, exposing employee(s) to the hazard of an 8 foot fall. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee engaged in residential construction activities 6 feet or more above lower levels are protected by guardrail systems, safety net systems, or personal fall arrest systems, or demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.
