29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:    a)  Kling Construction, Inc. at 3610 South Xenia Street, Denver, CO 80237:  On or before July 28, 2012, the employer did not ensure that a 10' deep trench for a new sewer line was inspected by a competent person prior to entry.  Condition exposed employees to cave-in hazards.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    a)  Kling Construction, Inc. at 3610 South Xenia Street, Denver, CO 80237:  On or before July 28, 2012, the employer allowed employees to install a new sewer line in a 10' deep trench, with walls sloped and benched between 62 and 70 degrees.  No trenchbox was in use.  Condition exposed employees to cave-in hazards.
