29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: On the west exterior elevation of a Race Trac service station under construction located at 4201 SE Federal Highway in Stuart, Florida: Employees performing metal framing work from the basket of an aerial lift approximately 16 ft. 3 inches above a lower level were not wearing a safety harness with a lanyard attached to the boom or basket of that lift, on or about August 1, 2012.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: On site of a Race Trac service station under construction located at SE Federal Highway in Stuart, Florida: An employee performing metal framing work from the basket of an aerial lift while exposed to fall hazards was not provided with a training program that would enable him to recognize the hazards of falling, on or about August 1, 2012. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
