29 CFR 1926.62(d)(1)(iii): With the exception of monitoring under paragraph (d)(3), where monitoring is required under this section, the employer shall collect personal samples representative of a full shift including at least one sample for each job classification in each work area either for each shift or for the shift with the highest exposure level.    (a) An exposure assessment was not conducted when employees were involved in the removal of lead based paint using methods such as power sanding without a dust collection system, scraping and heating on or about July 20, 2012, when lead was present as revealed by bulk samples collected by OSHA on August 3, 2012.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.62(d)(2)(v): Until the employer performs an employee exposure assessment as required under paragraph (d) of this section and determines actual employee exposure, the employer shall provide to employees performing the tasks described in paragraphs (d)(2)(i), (d)(2)(ii), (d)(2)(iii) and (d)(2)(iv) of this section with interim protection as follows:    (a) On or about July 20, 2012, employees were not provided with interim protective measures specified in this section, such as respiratory protection capable of protecting employees from lead at levels exceeding 500 micrograms per cubic meter of air, protective clothing, change areas, biological monitoring, and training; when they were involved in the removal of lead based paint using methods such as power sanding without a dust collection system, scraping and heating, prior to an exposure assessment being conducted.
