29 CFR 1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face: a) Job site, 2723 West Liberty Avenue, Dormont, PA: On or about August 1, 2012, while chipping away concrete from steel column bases during retaining wall construction activities, the employer did not ensure that employees were protected from loose material on excavation wall areas, exposing workers to struck by hazards. Employees were permitted to work around areas including, but not limited to, column number 12, where loose materials existed, areas were not scaled and no protection was provided.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) Job site, 2723 West Liberty Avenue, Dormont, PA: On or about August 1, 2012, while chipping concrete away from the base of steel columns during retaining wall construction activities, the employer did not ensure that a competent person conducted an inspection of the excavation for hazardous conditions. Employees were working in an excavation determined to be approximately 20-25 feet in depth wihtout an appropriate cave in system in use, exposing workers to wall collapses and excavation walls were not scaled, exposing workers to struck by hazards.

29 CFR 1926.652(b)(4)(i): Sloping and benching systems not utilizing Option (1) or Option (2) or Option (3) under paragraph (b) of this section were not approved by a registered professional engineer: a) Job site, 2723 West Liberty Avenue, Dormont, PA: On or about August 1, 2012, while chipping concrete away from the base of steel columns during retaining wall construction activities, the employer did not ensure that an appropriate cave in protection system existed for employees working near the excavated side of a hill determined to be approximately 20-25 feet tall. It was determined that it consisted of a lower half composed of approximately 10-12 feet of rock and had walls that were vertical, and an upper wall half composed of a class "b" soil that was approximatley 10-12 feet in height and wall angles determined to be approximately 75-80 degrees, with the upper two feet or so possibly sloped back a bit further. No registered professional engineer had designed or approved this configuration as adequate for cave in protection.
