29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminants chemical state and physical form: (a) Jobsite: Building 10, Acidulation Area - The employer did not identify and evaluate the respiratory and exposure hazards of acid vapors from the acidulation process. The employer allowed employees, at their discretion, to evacuate these areas when the employees were distressed from exposure to and/or from breathing the vapors. Observed on or about 8/8/2012. (b) Jobsite: Building 10, Blown Oil Cooking Area - The employer did not identify and evaluate the respiratory and exposure hazards of aldehyde and other organic vapors from the blown oil cooking process. The employer allowed employees to evacuate these areas when the employees were distressed from exposure to and/or from breathing the vapors. Observed on or about 8/8/2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employees were fit tested or required to use the respirator in the workplace: (a) Clay Bleaching Operation - Employees, who were required to wear single use particulate filtering masks while handling dusty bleaching clay containing high levels of silica and alumina, had not been provided medical evaluations to determine the employees' ability to use a respirator before the employees were required to use the respirator. Oberved on or about 8/8/2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
