29 CFR 1926.251(e)(8): "Removal from service." Synthetic web slings were not immediately removed from service when they had snags, punctures, tears or cuts. Employees were exposed to struck by hazards while using a synthetic sling rigged from the teeth of an excavator bucket. There were snags around the eye of the sling, the employer did not immediately remove the sling from service.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. An employee was setting concrete sewer pipe in a 94 x 111 excavation which was 59 deep was exposed to struck by hazards, and the employer did not initiate and maintain an accident prevention program to have daily inspections of the excavation, the adjacent areas, and protective systems in accordance with the OSHA regulations.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal). An employee was setting concrete sewer pipe in a 94 x 111 excavation which was 59 deep with vertical walls was exposed to struck by hazards, the employer did not use cave-in protection.
