The employer did not initiate and maintain an accident prevention program that would enable the employees to recognize the hazards and dangers associated with the tools and equipment being used in this demolition process. Employees used equipment such as but not limited to: acetylene and oxygen gases, an aerial lift, welding/cutting torch, and rough terrain forklifts. In using these equipment and tools the employees were exposed to falls, explosion from gas cylinders, and struck by hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. The compress gases are used for cutting metal structures. The forklifts were found to be in a defective condition with excessive leaks and damaged tires that affected the performance of the trucks' operation. The employees were exposed to a struck by possible failure of the trucks' hydraulic systems. The employer did not remove the truck from service until it was restored to a safe operating condition. a - Forklift #80636 severely leaking fluid and had damaged tires. b - Forklift #81036 severely leaking fluid and had damaged tires. c - Forklift 9323 severely leaking fluid and had damaged tires. OSHA ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees; in that employees were exposed to crushing and struck by hazards due to forklift tip over or equipment failure. On or about 08/07/12, employees were exposed to a crushing and struck by hazards while engaged in demolition work using a rough terrain forklift out on the yard to pull part of the structure down. Rough terrain forklifts are designed as material handling equipment and are not designed to pull, tow or drag other objects.
