29 CFR 1910.178(o)(1): Load(s) on powered industrial truck(s) were not stable or safely arranged:    On or about July 18, 2012, in Warehouse 3, the employer did not ensure that a primer-coated steel plate was stable and safely arranged on a forklift prior to allowing an employee to load, transport, and unload it.  The plate disengaged from the forks as an employee was preparing to unload it onto a flat-bed trailer; plate dimensions of 0.5"(h) x 96"(l) x 372"(w).

29 CFR 1904.39(a): The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees that resulted from a work-related incident within eight (8) hours:     On or about 07/18/2012, the employer failed to report to OSHA the work-related death of an employee within eight (8) hours.  The fatality was reported to OSHA on 07/19/2012 at approximately 0848 hours, about thirteen (13) hours after it occurred.
