29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. Location: 9 Drury Lane, Danvers, MA On or about 8/14/12, workers walking and working on the 8-pitch roof second deck of the single-story residential house did not utilize a fall protection system, while re-shingling the roof of the house and were exposed to falls of up to 22 feet.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: Location: 9 Drury Lane, Danvers, MA On or about 8/14/12, the two portable extension ladders that the workers were using to access the 22 foot single-story house did not extend at least 3 feet above the upper landing surface to which the ladder used to gain access or secured at the top of the ladder to a rigid support, exposing the employees to a 8 foot 10.5- inch fall.
