29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Jobsite: 1554 Constitution Boulevard, Arnold, PA 15068; On or before August 15, 2012, employees were working unprotected and exposed to fall hazards of approximately 16 feet 3 inches to ground level while on a 8/12 pitched roof. The employees were applying new shingles to an existing roof.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) Jobsite: 1554 Constitution Boulevard, Arnold, PA 15068; On or before August 15, 2012, the employer did not train their employee(s) on the hazards associated with falling while applying roofing materials on a steep sloped roof and what fall protection methods shall be used. Employee(s) were anticipating that 2x4's secured flat on the roof would prevent them from falling.
