29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. a) Jobsite located at 396 Williamstown Road, Sicklerville NJ 08081- Front of the facility: An employee of Brigalia's LLC., was exposed to fall hazards of approximately 20 feet to the ground below, when working/walking from a plank while performing painting activities at the worksite, observed on or about 07/27/2012.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews: a) Jobsite located at 396 Williamstown Road, Sicklerville NJ 08081- Front of the facility: An employee of Brigalia's LLC., was exposed to fall hazards of approximately 20 feet to the ground below, when working/walking from a plank located in between two prefabricated tubular scaffolds while performing painting activities at the worksite, observed on or about 07/27/2012. ABATEMENT NOTE: Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews. A standard guardrail system includes a top rail, a midrail, and toe boards. The height of the top rail for scaffolds must be between 38 inches (0.97 m) and 45 inches (1.2 m). When the cross point of cross bracing is used as a top rail, it must be between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform. Midrails must be installed approximately halfway between the top rail and the platform surface. When a cross point of cross bracing is used as a midrail, it must be between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform.
