On August 16, 2012, at this job site, employees were allowed to do water service installation in a trench measuring approximately seven feet deep by nine feet wide by twenty-five feet long. The exposed employees were not protected from cave-in by the use of a complete shoring, trench-box, or adequate sloping of the excavation sides.

On August 16, 2012, at this job site, the employer did not comply with the provisions of 29 CFR 1926.652(b)(1)(i) in that the employees were allowed to do water service installation in a trench measuring approximately seven feet deep by nine feet wide by twenty-five feet long. The exposed employees were not protected from cave-in by the use of a complete shoring, trench-box, or adequate sloping of the excavation sides.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On August 16, 2012, at this job site, employees were allowed to gain access to the bottom of an trench excavation measuring approximately 7 foot deep using an extension ladder that the side rails did not extended past or above the excavation cut landing. This condition exposed the employees to a fall hazard.

On August 16, 2012, at this job site, employees were allowed to gain access to the bottom level of a trench measuring approximately seven feet deep by nine feet wide by twenty-five feet long by using a Werner extension ladder that had the side extension rails damaged, broken and split.
