29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).     On August 16, 2012, at this job site, employees were allowed to do water service installation in a trench measuring approximately seven feet deep by nine feet wide by twenty-five feet long. The exposed employees were not protected from cave-in by the use of a complete shoring, trench-box, or adequate sloping of the excavation sides.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.    On August 16, 2012, at this job site, the employer did not comply with the provisions of 29 CFR 1926.652(b)(1)(i) in that the employees were allowed to do water service installation in a trench measuring approximately seven feet deep by nine feet wide by twenty-five feet long. The exposed employees were not protected from cave-in by the use of a complete shoring, trench-box, or adequate sloping of the excavation sides.

29 CFR 1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    On August 16, 2012, at this job site, employees were allowed to gain access to the bottom of an trench excavation measuring approximately 7 foot deep using an extension ladder that the side rails did not extended past or above the excavation cut landing. This condition exposed the employees to a fall hazard.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.    On August 16, 2012, at this job site, employees were allowed to gain access to the bottom level of a trench measuring approximately seven feet deep by nine feet wide by twenty-five feet long by using a Werner extension ladder that had the side extension rails damaged, broken and split.
