This violation was observed on August 16, 2012 at a jobsite located at the 100 block of McKelvey Street, Atlanta, Texas; where at least two employees were working in a trench over 40 feet in length without a safe means of egress within 25 feet.

The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal):            The employer does not protected employees from cave-ins by an adequate protective system.
