OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employeesin that employees were exposed to falling while climbing out of an scissor lift while it was elevated.     (a) Location - 27 Congress Street, Salem, Ma:  On or about 8/14/2012, employees were exposed to the hazard of falling while climbing out of and into a scissor lift while it was elevated.     Among other means, one feasible means of abatement would be to read and follow the manufacturer's operational manual in which it states "never use the elevating assembly to enter or leave the platform.

29 CFR 1926.451(g)(1)(vii):     For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    (a) Location - 27 Congress Street, Salem, Ma:  On or about 8/14/2012, employees were not protected from falling while working from a JLG scissor lift scaffold that had the guardrails removed.

29 CFR 1926.454(a):     The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    (a) Location - 27 Congress Street, Salem, Ma:  On or about 8/14/2012, employees who were utilizing a scissor lift scaffold were not adequately trained to recognize hazards and proper precautions to be taken prior to using the scissor lift.

29 CFR 1926.501(b)(1):     Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    (a) Location - 27 Congress Street, Salem, Ma:  On or about 8/14/2012, employees were not protected from falling while working from a roof that was greater than six feet above a lower level.
