29 CFR 1926.20(b)(1):     It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.    a.  On or about August 17, 2012 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to falls.

29 CFR 1926.501(b)(4)(i):     Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.    a.  On or about August 17, 2012 - at the above addressed jobsite, an employee performing framing operations was exposed to falls, of approximately eight (8) feet, due to unprotected floor holes on the third floor.
