29 CFR 1926.501(b)(13):     Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b)  Note:  If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502:    Mauck Zantzinger & Associates was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 316226992, citation number 1, item number 2 and was affirmed as a final order on 04/06/2012, with respect to a workplace located at 3028 Newark St., NW, Washington, D.C.    a)  Rear of House, Deck -  Two carpenters constructing a wooden deck were not provided with fall protection and were exposed to a 9 foot fall, on or about 08/21/2012.

29 CFR 1926.403(b)(1)(i):     Safety of equipment was not determined on the basis of suitability of the equipment for an identified purpose as evidenced by listing, labeling, or certification for that identified purpose:    a)  Frist Floor - A Woods Surge Suppressor, model #5709 (no serial number) which is designed for home use, was subjected to hard service, in that, the suppressor was used to power a portable circular saw in a commercial construction environment, on or about 08/21/2012.
