29 CFR 1926.1101(m)(1)(i)(B):     For employees otherwise required by this standard to wear a negative pressure respirator, employers did not ensure employees are physically able to perform the work and use the equipment. This determination was not made under the supervision of a physician:    Employees removing asbestos-containing shingles at 302 N. Morrison St. in Appleton, Wisconsin, on 8/23/12, and utilizing MSA Model 3411 air purifying respirators were not provided with medical surveillance prior to wearing the respirators.     ABATEMENT CERTIFICATION AND ABATEMENT DOCUMENTATION REQUIRED.

29 CFR 1926.1101(h)(2)(i):     The employer did not implement a respiratory protection program in accordance with 1910.134 (b) through (d) (except (d)(1)(iii)), and (f) through (m), which covered each employee required by this section to use a respirator:    a) A written respirator program was not established (as required by 1910.134(c)) for employees utilizing MSA Model 3411 1/2 mask air purifying respirators to protect them against asbestos exposures, and while performing Class II asbestos removal.     b) Fit testing was not performed (as required by 1910.134(f)) for employees utilizing MSA Model 3411 1/2 mask air purifying respirators to protect them against asbestos exposures, and while performing Class II asbestos removal.    c) Procedures for regularly evaluating the effectiveness of the respirator program were not established (as required by 1910.134(l)) for employees utilizing MSA Model 3411 1/2 mask air purifying respirators to protect them against asbestos exposures, and while performing Class II asbestos removal.    ABATEMENT CERTIFICATION AND ABATEMENT DOCUMENTATION REQUIRED.
