29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that:    a) 24 South Main Street - On or about 23 August, 2012 - Subcontractor employees were working in an excavation that was 12 feet wide by 12 feet long by 6 feet deep, with vertical walls, without any protective systems. Employees were exposed to a crushing hazard.

29 CFR 1926.651(e): Employee was not prohibited to be underneath loads handled by lifting or digging equipment:    a) 24 Main Street - On or about 23 August, 2012 - Subcontractor employees were working in an excavation underneath a suspended load handled by digging equipment. Employees had to walk underneath the suspended load to enter and exit the excavation. Employees were exposed to a struck by hazard.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:    a) 24 South Main Street - On or about 23 August, 2012 - Subcontractor employees were working in the excavation without the use of hard hats while machinery was moving suspended loads of dirt around the excavation. Employees had to walk underneath the suspended load to enter and exit the excavation. Employees were exposed to a struck by hazard.
