OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards created by the use of industrial storage racks which were not anchored to the floor:      a) Main Garage welding area, 231 York Lane, Export, Pennsylvania, 15632.    Observed on or about September 05, 2012, employees were using an industrial storage rack to that was not anchored to the floor.  The industrial storage rack was used to store cleaning solution, tools, and automotive parts.  The industrial storage rack was located in an area of forklift and vehicular traffic.  Employees engaged in vehicle maintenance and tank welding activities in the main garage area were exposed to crushed-by and struck-by hazards.        b) Upper Warehouse Building, 231 York Lane, Export, Pennsylvania, 15632. Observed on or about September 05, 2012, industrial storage racks used to store pallets of petroleum products were not anchored to the floor.  The industrial storage racks were located in an area of forklift traffic.  Employees working in the Upper Warehouse Building were exposed to struck-by and crushed-by hazards.

Employees using the platform to load trucks were exposed to a fall hazard of approximately 8 feet 6 inches to the concrete surface below.      b) Main Shop, 231 York Lane, Export, Pennsylvania, 15632:  Observed on or about September 05, 2012, a storage area located above the employee restroom was not equipped with guardrails.  Employees using the platform to store materials and to access electrical panel boxes were exposed to a fall hazard of approximately 10 feet to cement floor below.
