29 CFR 1910.23(a)(8):     Every floor hole into which persons can accidentally walk were not guarded:    (a) BW02 Shaft Level 8 - The floor area ajacent to the access ladder was covered by grating except a hole measured 8 inches long by 9 inches wide with a fall or drop of >12 feet was not protected by the grating or guarded to protect employees from stepping into the hole.      (b) BW02 Shaft Level 8 - The grating adjacent to the mechanical ducting left a gap that measured 63 inches long and 7 inches wide with a drop of >12 feet.  This unprotected floor was not guarded to protect employees from stepping into the opening.

29 CFR 1910.23(c)(1): Open-sided platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides:    (a) East Shaft - Maintenance employees accessed a platform in the east shaft to perform maintenance activity via a 32 inch x 32 inch doorway from the hallway. This platform had no standard railings or equivalent fall protection exposing employees to a fall hazard of 15-20 feet.

29 CFR 1910.23(e)(1): Standard railing(s) did not consist of top rail, intermediate rail and/or posts and/or did not have a vertical height of 42 inches (106.7 cm) nominal from upper surface of top rail to floor, platform runway, or ramp level:    (a) BW02 Shaft Level 3 - The rails around the floor opening for the access ladder was missing the intermediate or mid-rail.   Employees were exposed to a fall of approximately 10-12 feet to the lower level.    (b) BW02 Shaft Level 5 - The rails around the floor opening for the access ladder was missing the intermediate or mid-rail.  Employees were exposed to a fall of approximately 10-12 feet to the lower level.    (c) BW02 Shaft Level 8 - The rails around the floor opening for the access ladder was missing the intermediate or mid-rail.  When measured, the top rail was 35 inches in height and the width of the opening was 28 inches. Employees were exposed to a fall of approximately 10-12 feet to the lower level.

29 CFR 1926.1101(k)(6): At the entrance of the mechanical rooms/areas in which employees could reasonably be expected to enter and which contained ACM and/or PACM, the building owner did not post signs identifying the material present, its location, and appropriate work practice which, if followed will ensure that asbestos containing material and/or presumed asbestos containing material will not be disturbed:    (a)  BW02 Shaft - Although signs were posted at the access doors identifying that ACM was present in the shaft, there were no signs regarding appropriate work practices to ensure that ACM material would not be disturbed.  On the 3rd level of the shaft, recent electrical work by an outside contractor had been conducted and a conduit pipe had been place against the ACM pipe insulation potentially damaging the insulation.

29 CFR 1926.1101(k)(9)(vi): Training for employees performing Class IV operations did not include available information concerning the locations of thermal system insulation and surfacing asbestos containing material and/or presumed asbestos containing material, asbestos-containing flooring materials, or flooring material where the absence of asbestos has not yet been certified; and instruction in recognition of damage, deterioration, and delamination of asbestos containing building materials; and did not take at least 2 hours:    (a) BW02 Shaft - In the course of conducting maintenance activities, including but not limited to, installation of lighting, painting insulated materials, running electrical wiring, or repairing leaking water lines, maintenance employees were not provided training that included the specific locations of the ACM thermal system insulation and sufacing materials, how to recognize damaged or deteriorated ACM and/or the proper response to all fiber release episodes when these employees entered and conducted work in the shaft.
