29 CFR 1910.151(c): Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use:    a)  Pool Mechanical room,     The employer did not ensure that employees who are required to use chlorine which is a corrosive were provided with an adequate eyewash.  The employer did have an eye wash bottle but this does not meet the ANSI requirement of at least 15 minutes of continuous flush (ANSI Z358.1 1998 section 7.1.4.).  Condition noted on or about 08/29/12.      NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.19.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section will be met:    a) In the basement pool area,     The employer did not develop or implement a written hazard communication program for employees who are required to use hazardous chemicals such as but not limited to chlorine and muriatic acid when maintaining the pool.  Condition noted on or about 08/29/12.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.19.

29 CFR 1910.1200(f)(5): Except as provided in paragraphs (f)(6) and (f)(7) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with the following information:    a) In the basement pool mechanical room,     The employer did not ensure that both chlorine and muriatic acid tanks were properly labeled with the identity and the hazards associated for each chemical that is contained in each tank.  Employees are required to use these chemicals contained in these tanks to maintaining the pool at the facility.  Condition noted on or about 08/29/12.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.19.
