OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while using improperly maintained mobile ladder stands. a) Warehouse Area, Second Aisle, Third Shelf Level - On or about August 29, 2012, employees were tasked to retrieve merchandise from a multi-tier shelving unit. All the mobile ladder stands available and used by employees to perform their duties were missing safety rubber stops, exposing employees to fall hazards, between 4 and 15 feet.
