OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees; in that, employees were exposed to serious fall and operating hazards.    On September 3, 2012, the Strato Tower aerial lift being used by an employee conducting window washing cleaning operations failed, resulting in the employee falling approximately 50 feet to the ground.  The employer did not institute a program of completing frequent and periodic inspections of the boom.    **In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.**

29 CFR 1910.67(c)(2)(ix):     Articulating boom and extensible boom platforms, primarily designed as personnel carriers, did not have both platform (upper) and lower controls. Upper controls were not in nor beside the platform within easy reach of the operator. Lower controls did not provide for overriding the upper controls. Controls were not plainly marked as to their function. Lower level controls were operated without obtaining permission from the employee in the lift:    a)  The platform (upper) controls of the 1988 Ford F700 vehicle mounted aerial lift truck were not marked as to their function.      **In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
