29 CFR 1926.404(b)(1)(i): The employer did not use either ground fault circuit interrupters (GFCI) or an assured grounding program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites from electric shock hazard when using electric tools and equipment:    a)  GFCI was not provided on four (black) electric outlet pigtails installed on the main power panel.  Employees had two extension cords plugged in and operating electric tools on these circuits.  Employees were exposed to electric shock hazard.    Location:  21 E 1st Street, New York, N.Y.     On or about 8/16/2012     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which is 6 feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    a)  Several employees were working without fall protection at the top deck, 10fl.  Employees went to the edge at sw corner of top deck to install formwork and plywood in an area where there were no guardrails.       Location:  21 E 1st Street, New York, N.Y.     On or about 8/16/2012     NOTE: ABATEMENT IS DOCUMENTED IN THE CASEFILE, THEREFORE THE EMPLOYER NEED NOT SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

Employees went to the edge of the 10fl top deck without fall protection, did not go get a lifeline to tie off to; fall protection equipment (rope lifeline) was worn out.
