29 CFR 1926.95(a):     Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition, wherever it was necessary by reason of hazards of process or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:    On or about 09/05/12, an employee was mixing hazardous chemicals, Alamo Concrete and Chemstar Type S Lime, while mixing these products the employee was not wearing the proper/adequate personal protective equipment.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fall, struck-by and crushed-by:    On or about 09/05/12, the employer does not ensure that employees operating powered industrial trucks use seatbelts, exposing employees to the hazard of falling out of and being struck by the powered industrial truck.  The forklift operator did not use a seatbelt while operating the GEHL forklift, Model RS5-34, while transporting mortar around the jobsite.
