29 CFR 1910.178(l)(1): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demostrated by the successful completion of the training and evaluation specified in this paragraph (l): a. Warehouse and Dock Areas - On or about September 11, 2012, employees were required to operate electric powered industrial trucks to load and unload product on shelves and the employer had not ensure that each operator had demostrated the succesful completion of the training and evaluation on the safe operation of industrial trucks. Employees were thereby exposed to the hazards of operating industrial trucks.

29 CFR 1904.29(a): Basic requirement. You must use OSHA 300, 300-A, and 301 forms, or equivalent forms, for recordable injuries and illnesses. The OSHA 300 form is called the Log of Work-Related Injuries and Illnesses, the 300-A is the Summary of Work-Related Injuries and Illnesses, and the OSHA 301 form is called the Injury and Illness Incident Report. a. Entire Facility - On or about September 11, 2012, the employer did not have the OSHA log forms kept at the establishment for review upon request. The OSHA log forms were the following; 1. The OSHA 300 log forms for year 2010, 2011, and 2012. 2. The OSHA 300-A log forms for year 2010 and 2011.

The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks shall be in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in Sec. 1910.6. a. Dock Area/East side of Building - On or about September 11, 2012, a non-secure compressed gas cylinder of nitric oxide (NO) was kept in a congested area with moving material handling equipment and personnel. Employees were thereby exposed to the hazards of explosion and fire.

The Director shall also be given access to material safety data sheets in the same manner. a. Testing Laboratory Area - On or about September 11, 2012, the material safety data sheets for several gasses were not kept available for review upon request at the company. The several material safety data sheets not available were the following; 1. The material safety data sheet for nitric oxide compressed gas (NO). 2. The material safety data sheet for carbon dioxide compressed gas (CO2).
