29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: A. On September 11, 2011 an employee was allowed to work in a 4.10 foot deep trench without a ladder, exposing the employee to the hazards associated with no safe egress. B. On September 11, 2011 an employee was allowed to work in a 6.3 foot deep trench without a ladder, exposing the employee to the hazards associated with no safe egress. There is no abatement certification or documentation required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. On September 11, 2012, an employee was not provided cave-in protection, exposing the employee to the hazards associated with working in a 6.3 foot deep unprotected trench. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
