29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). Nor had the employer complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical.      a)  Hill Ave., Berlin Twsp., NJ:  Two employees were exposed to caught-in and crushing hazards while working in an unshored trench greater than 6 feet deep, 8.5 feet wide at top / approx. 5 feet wide at bottom and approx 20 feet length with nearly vertical side walls.  The employees were not protected from cave-ins by adequate protective systems, shoring, sloping or benching.  Observed on or about 09/11/12.     NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
