29 CFR 1904.4(a):     Basic requirement. Each employer required by this Part to keep records of fatalities, injuries, and illnesses must record each fatality, injury and illness that:  is work-related; is a new case; and meets one or more of the general recording criteria of  1904.7 or the application to specific cases of  1904.8 through  1904.12:    At the facility located at 67670 Traco Drive, Saint Clairsville, Ohio, on or about September 14, 2012, the employer had not recorded the following recordable workplace injuries or illnesses on the 2012 OSHA 300 Log or its equivalent:    a. On August 26, 2012, an employee was injured while working as a mental health technician and sent out for medical evaluation and treatment.  The employer did not list the employee injury on the OSHA Log but the employee medical record indicated the employee had 1 lost day of work due to a hand/wrist sprain.    b. On July 8, 2012, an employee was injured while working as a mental health technician.  The employer did not list the injury on the 2012 OSHA 300  Log or provide an OSHA 301/equivalent, but the employee medical record indicated the employee had 1 lost day with a shoulder contusion.    c. On July 28, 2012, an employee was injured while working as a mental health technician.  The employer did not list the icjury on the 2012 OSHA 300 Log or provide an OSHA 301/equivalent, but the employee medical record indicated the employee had 1 lost day with a concussion.    d. On November 3, 2012, an employee was injured while working as a mental health technician.  The employer did not list the injury on the 2012 OSHA 300 Log or provide OSHA 301/equivalent, but the employee medical record indicated the employee had 1 lost day from being struck by a resident, resulting in contusions to the face, scalp and neck.    e.  On September 10, 2012, an employee was injured while working as a mental health technician.  The employee's right shoulder was strained when his hand was shut in a door three times by a patient.  The employee was sent out for medical evaluation and treatment of right hand and shoulder pain/strain.    f. On October 12, 2012, an employee was injured while working as a mental health technician.  The employee strained his abdomen while restraining a patient and was sent out for medical evaluation and treatment.  The employee had recently returned to work from a previous abdominal surgery unrelated to his job duties.  The employee had not returned to work from his work-related injury as of December 13, 2012.    g. On August 6, 2012, an employee was injured while performing working as a mental health technician.  The employee had injuries to the knee and leg from being kicked by a patient and was sent out for medical evaluation and treatment, missing ten days of work.    h. On September 22, 2012, an employee was injured while working as a mental health technician.  The employee had injuries from being struck in the ankle by a patient and was sent out for medical evaluation and treatment, missing three days of work.    i. On November 9, 2012, an employee was injured while working as a mental health technician.  The employee had injuries to the wrist and hand from being struck by a patient and was sent out for medical evaluation and treatment, missing eighteen days of work.    BHC Fox Run Hospital was previously cited for a violation of this occupational safety and health standard 29 CFR 1904.4(a) or its equivalent, which was contained in OSHA inspection number 313151946, citation number 1, item numbers 1(a) and 1(b), and was affirmed as a final order on May 11, 2010, with respect to the workplace located at 67670 Traco Drive, Saint Clairsville, OH   43950.

29 CFR 1904.29(b)(3):     How quickly must each injury or illness be recorded? You must enter each recordable injury or illness on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness has occurred:    At the facility located at 67670 Traco Drive, Saint Clairsville, Ohio, on or about Setember 14, 2012, the employer had not recorded within seven days, the following workplace injuries or illnesses on the 2012 OSHA Log or its equivalent:    a. At the facility located at 67670 Traco Drive, Saint Clairsville, Ohio, on the 2012 OSHA 300 Log, the employer did not record case #6 that occurred on September 7, 2012 within seven calendar days, in that it was recorded after case #5 that occurred on October 13, 2012.    BHC Fox Run Hospital was previously cited for a violation of this occupational safety and health standard 29 CFR 1904.29(b)(3) or its equivalent, which was contained in OSHA inspection number 313151946, citation number 1, item numbers 3(a) and 3(b), and was affirmed as a final order on May 11, 2010, with respect to the workplace located at 67670 Traco Drive, Saint Clairsville, OH   43950.

When an injury or illness involves restricted work or job transfer but does not involve death or days away from work, you must record the injury or illness on the OSHA 300 Log by placing a check mark in the space for job transfer or restriction and an entry of the number of restricted or transferred days in the restricted workdays column:    At the facility located at 67670 Traco Drive, Saint Clairsville, Ohio, on or about Setember 14, 2012, the employer had not correctly recorded the following workplace injuries or illnesses on the 2012 OSHA 300 Log or its equivalent in columns (K) and/or (L).:    a. On September 7, 2012, an employee was injured while working as a mental health technician.  The entry in Column (K) by the employer was 0 days away from work and the employer entry in Column (L) was 0 days of restricted work/transfer.  The employee medical records showed the employee had 1 day away from work.    d. On October 11, 2012, an employee was injured while working as a mental health technician.  The entry in Column (K) by the employer was 3 days away from work and the employer entry in Column (L) was 0 days of restricted work/transfer.  The employee medical records showed the employee had 3 days away from work and 23 days of restricted duty.    e. On November 14, 2012, an employee was injured while working as a mental health technician.  The entry in Column (K) by the employer was 1 1/2 days away from work and the employer entry in Column (L) was 0 days of restricted work/transfer.  The employee medical records showed the employee had 2 days away from work.    f. On November 17, 2012, an employee was injured while working as a mental health technician.  The entry in Column (K) by the employer was 0 days away from work and the employer entry in Column (L) was 0 days of restricted work/transfer.  The employee medical records showed the employee had 1 day away from work.

You must enter information about your business at the top of the OSHA 300 Log, enter a one or two line description for each recordable injury or illness, and summarize this information on the OSHA 300-A at the end of the year:    a. At the facility located at 67670 Traco Drive, Saint Clairsville, Ohio, at the time of inspection, the employer had not recorded information in column (F) correctly for calendar year 2012 a description of work-related injuries and illnesses.  On or about September 7, 2012, an employee had an injury to lumbar region but there was no description of what caused the injury or what the employee was doing when the injury occurred.    b. At the facility located at 67670 Traco Drive, Saint Clairsville, Ohio, at the time of inspection, the employer had not recorded information in column (F) correctly for calendar year 2012 a description of work-related injuries and illnesses.  On or about October 11, 2012, an employee had a right knee sprain but there was no description of what caused the injury or what the employee was doing at the time of injury.    c. At the facility located at 67670 Traco Drive, Saint Clairsville, Ohio, at the time of inspection, the employer had not recorded information in column (F) correctly for calendar year 2012 a description of work-related injuries and illnesses.  On or about October 13, 2012, an employee had an injury to the right index finger but there was no description of what caused the injury or what the employee was doing at the time of injury.    d. At the facility located at 67670 Traco Drive, Saint Clairsville, Ohio, at the time of inspection, the employer had not recorded information in column (F) correctly for calendar year 2012 a description of work-related injuries and illnesses.  On or about November 14, 2012, an employee had an injury listed as concussion to the head and hematoma but there was no description of the hematoma, what caused the injury or what the employee was doing at the time of injury.    e. At the facility located at 67670 Traco Drive, Saint Clairsville, Ohio, at the time of inspection, the employer had not recorded information in column (F) correctly for calendar year 2012 a description of work-related injuries and illnesses.  On or about November 17, 2012, an employee had an injury to the left knee but there was no description of what caused the injury or what the employee was doing at the time of injury.
