29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. (a) Building 7, Cornell Court - An employee working on the roof was lowered to the ground in a Gradall, model 534D9-45. The employer did not insure that employees were tied off when on the platform, on or about September 13, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b), Note: If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502. (a) Building 7 Cornell Court Harrisburg Pennsylvania - Employees worked on the roof of an apartment complex exposed to approximately 28 foot fall. The employer did not ensure that employees were provided with conventional fall protections methods, on or about September 13, 2012. (b) Building 7 Cornell Court Harrisburg Pennsylvania - An employee worked inside the apartment complex clean up. The employer did not ensure that the employee was protected from falling through open windows, on or about September 13, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
