29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about August 4, 2012, the employer had not provided underground tunneling training to employees who were engaged in a hand excavating dirt and gravel horizontally under a concrete slab floor. Employees were not trained to recognize the unsafe condition(s) that was created during their digging operation and exposed employees to tunnel side wall collapse.

29 CFR 1926.800(o)(3)(i)(A): A competent person did not inspect the roof, face, and wall of the underground construction work area at the start of each shift and as often as necessary to determine ground stability: a) On or about August 4, 2012, a competent person did not inspect the ground conditions of a underground tunnel excavation and as needed throughout the shift for soil condition(s) that were unstable and presented a collapse potential while employees removed the dirt and gravel in effort to find a water service line leak at a horizontal direction under the concrete slab floor.
