29 CFR 1926.21(b)(2):     The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a) On or about August 4, 2012, the employer had not provided underground tunneling training to employees who were engaged in a hand excavating dirt and gravel horizontally under a concrete slab floor. Employees were not trained to recognize the unsafe condition(s) that was created during their digging operation and exposed employees to tunnel side wall collapse.

29 CFR 1926.800(o)(3)(iii):     Loose ground that could be hazardous to employees in underground construction work areas was not taken down, scaled or supported:    a) On or about August 4, 2012, the damp soil and gravel side walls of the tunnel excavation that presented a collapse potential while employees were inside the tunnel hand digging the tunnel face was not removed and or shored to prevent side wall collapse onto employee(s).
