29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: a) Panera Bread, 1500 Nixon Drive, Moorestown, NJ: An eye wash providing at least 15 minutes of a continuous flow was not provided for use where employees work with and around corrosive products including but not limited to Greasestrip, Clorox, Lime-A-Way, and Oasis 146 Multi-Quat Sanitizer, observed on or about 09/12/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. a) Panera, 1500 Nixon Drive, Moorestown, NJ: When a member of Management supplied an employee with a new product (Drano) to be used in the facility, the hazards associated with the product were not communicated to the employee prior to use, occurred on or about 9/6/12. BY THIS DATE THE EMPLOYER MUST EITHER CORRECT THE ALLEGED VIOLATION(S) OR IMPLEMENT A FIRE SAFETY POLICY, AS OUTLINED IN 29 CFR 1910.38 WHICH INCLUDES THE EVACUATION REQUIREMENTS OF 29 CFR 1910.157(b).
