29 CFR 1910.1025(l)(1)(i): Employee(s) working in an area where there is potential exposure to airborne lead at any level were not informed of the content of Appendices A and B of 29 CFR 1910.1025: (a) On or about 10/16/2012, in fabrication area, for the fabricator grinding hot/cold rolled steel which generated metal dust and metal particulate. The mill cert for hot/cold rolled steel sheet states that this steel product may contain traces of lead. Wipe sample collected by OSHA from the inside of the respirator used by the employee contained 292.9 micrograms of lead. The employer did not provide content of Appendices A and B.

The mill cert for hot/cold rolled steel sheet states that this steel product may contain traces of lead. Wipe sample collected by OSHA from the inside of the respirator used by the employee contained 292.9 micrograms of lead. Employee was required to wear 3M half-face respirator that was hanging on the wall dirty and was used by more than one person. The employer did not ensure that respirator was cleaned for different users.

29 CFR 1910.134(c)(1): In the workplace where respirators were necessary to protect the health of the employee or where respirators were required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures including the provisions (i)-(ix) of this section, as applicable: (a) On or about 10/16/2012, in fabrication area, for a fabricator required to wear a 3M half-face respirator with organic vapor cartridges while painting bullet traps. The employer did not implement a respiratory protection program. Rothe Welding, Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 1910.134(c)(1) which was contained in OSHA inspection #190857, Citation 1, Item 1. This citation was issued May 11, 2012, became a final order on June 06, 2012 and had final abatement day of June 10, 2012. On June 11, 2012 employer requested PMA for 30 days which moved abatement date to July 10, 2012. Employer did not process full PMA request. Abatement Note: The Respiratory Protection Program shall include the following sections: (1) Procedures for selecting respirators for use in the workplace; (2) Medical evaluations of employees required to use respirators; (3) Fit testing procedures for tight-fitting respirators; (4) Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations; (5) Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators; (6) Procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere- supplying respirators (if used); (7) Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations; (8) Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and (9) Procedures for regularly evaluating the effectiveness of the program.
