29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a)  Exterior, Between Building and Sidewalk - Employees were not provided adequate training in hazards associated with working in excavations as evidenced by an employee hand digging an excavation 6 feet in depth, 3 feet 6 inches in width, and 9 feet 6 inches in length, where an inadequate shoring system, an upright sheet of plywood with a 2X4 inch stiff back and a 2X4 inch kicker was provided.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):    a) Exterior, Between Building and Sidewalk - A laborer  hand digging in search of an existing sanitary line was observed in an excavation that measuried 6 feet deep, 3 feet 6 inches wide, and 9 feet 6 inches long, provided with a shoring system consisting of an upright 4X8 foot sheet of plywood with a 2X4 inch stiff back and a 2X4 inch kicker, thereby exposing the laborer to a cave-in hazard.
