29 CFR 1926.501(b)(10): Employee(s) engaged in roofing activities on low-sope roofs, with unprotected sides and edges 6 feet (1.8m) or more above lower levels were not protected from falling by a guardrail system, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system:    a) New Tim Horton's Building on Main Street in Jamestown, two (2) employees observed working on low pitched roof doing roofing work without any type of fall protection being utilized. The employees were exposed to falls of approximately 14' 10" to the ground below.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend to at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access nor was the ladder secured at it's top to a ridgid support and a grasping device, such as a grabrail, provided to assist the employee in mounting and dismounting the the ladder:    a) New Tim Horton's Building on Main Street in Jamestown,  20 foot aluminum extension ladder being used for access to and from the roof of the building only extended approximately three (3) inches above the roof.    NO ABATEMENT CERTIFICATION NEEDED

29 CFR 1926.1053(b)(8): Ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were not secured to prevent accidental displacement, nor was a barricade used to keep the activities or traffic away from the ladder:    a) New Tim Horton's Building on Main Street in Jamestown, twenty (20) foot aluminum extension ladder being used for access to and from the roof was not tied-off to prevent it from being displaced.    NO ABATEMENT CERTIFICATION REQUIRED
