29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions.    a) Interior walls of the house: on or about September 25, 2012, and at times prior thereto, the employer did not instruct and/or enforce the use of eye-protection that met the requirements of  the American National Standards Institute, Z87.1-1968, while employees, installing wall sheathing, utilized power tools such as, but not limited to, pneumatic nail guns.    Note: Abatement certification IS required for this item.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) South facing side of site, at the joining of an interior north-south partition wall with an exterior east-west wall: on or about September 28, 2012, and at times prior thereto, an employee was standing and working from the tops of walls without a means of fall protection.    Note Abatement certification IS required for this item.
