29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: The employer does not ensure that employees wear the proper protective equipment while operating forklifts. This violation was observed on or about October 02, 2012, at the facility where an employee was exposed to crushed-by hazards while operating a forklift without wearing a seatbelt. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees are trained in the use of, and required to use, seatbelts while operating forklifts.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: The employer does not guard the rotating parts of machines whose operation exposes employees to injury. a. This violation was observed on or about October 02, 2012, in the fabrication area where employees were exposed to struck-by and caught-by hazards when operating a manual Jones & Lamson brand metal lathe without a chuck guard. b. This violation was observed on or about October 02, 2012, in the fabrication area where employees were exposed to struck-by and caught-by hazards when operating a VT 36 Fortune brand CNC metal lathe at workstation #1 without interlocking door guards. c. This violation was observed on or about October 02, 2012, in the fabrication area where employees were exposed to struck-by and caught-by hazards when operating a VT 26 Fortune brand CNC metal lathe at workstation #2 without interlocking door guards. d. This violation was observed on or about October 02, 2012, in the fabrication area where employees were exposed to struck-by and caught-by hazards when operating a Super Max-4 CNC Mill at workstation #3 without interlocking door guards. e. This violation was observed on or about October 02, 2012, in the fabrication area where employees were exposed to struck-by and caught-by hazards when operating a Kingston CL38 brand CNC metal lathe at workstation #4 without interlocking door guards. f. 29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace: The employer does not ensure that employees required to operate forklifts are trained and evaluated to ensure they can operate them safely. This violation occurred on or about October 02, 2012, and at times prior thereto, when an employee in the facility was required to operate forklifts while moving material without having been trained and evaluated to ensure he could do so safely. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that they provide the employees training consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.
